1. As a matter of law, a charge of attempted domestic abuse murder cannot lie because specific intent, which is required for an attempted crime pursuant to Minn. Stat. ร§ 609.17 (1996), is not an element of the offense of domestic abuse murder under Minn. Stat. ร§ 609.185(6) (1996). 2. To sustain a conviction for pattern harassment, Minn. Stat. ร§ 609.749, subd. 5 (1996), the state must prove beyond a reasonable doubt each element of pattern harassment, including elements of the underlying crimes.
